1. Acceptance of Terms

Welcome to HEKA Calendar ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the HEKA Calendar mobile application, website, and related services (collectively, the "Service").

By downloading, installing, or using HEKA Calendar, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

HEKA Calendar is a calendar and timekeeping application that provides:

• Calendar Functionality: A 13-month calendar system with note-taking and organization features
• Astrological Features: Birth charts, planetary positions, transits, and astrological interpretations (the "Astrology Services")
• Journal System: Personal diary and reflection tools with optional celestial context
• Optional Cloud Sync: Cross-device synchronization via Firebase (requires account creation)

3. User Accounts

3.1 Account Creation

You may use HEKA Calendar without creating an account. An account is only required for:

• Cloud sync across devices
• Data backup and recovery
• Accessing premium features (if applicable)

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.3 Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Infringe on intellectual property rights

You may delete your account at any time through the app settings. Deletion removes cloud data but does not affect locally stored data on your devices.

4. Social Features & Community Guidelines

4.1 Cosmic Circle & Friend Connections

HEKA Calendar offers optional social features including:

• Cosmic Circle: Connect with friends via invite codes to share celestial moments and support
• Task Sharing: Share task rituals with other users via unique, time-limited invite links
• Community Voting: Participate in anonymous voting for community holidays and feature preferences

4.2 Community Guidelines

By using social features, you agree to:

• Only connect with people you know or who have shared an invite code with you
• Not use the service to harass, bully, threaten, or spam others
• Not share illegal, harmful, offensive, or discriminatory content
• Not impersonate others or misrepresent your identity
• Respect the privacy of your connections

We reserve the right to suspend or terminate access to social features for violations of these guidelines.

4.3 Profile Content

You are responsible for your profile information (display name, avatar) and any content you share in messages or tasks. Shared task links expire after 7 days and can only be accepted once.

5. User Conduct

5.1 Acceptable Use

You agree to use HEKA Calendar only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to generate or distribute harmful, threatening, or discriminatory content
• Impersonate another person or misrepresent your identity

5.2 AI Features (Optional — Bring Your Own API Key)

HEKA Calendar offers optional AI-enhanced astrological readings. Important: We do not provide AI services directly. Instead, you may choose to connect your own AI provider account.

Your responsibilities:

• Creating and maintaining your own account with the AI provider
• Complying with that provider's terms of service and privacy policy
• Paying all costs associated with API usage (though many providers offer free tiers)
• Securing your API key (do not share it or commit it to public repositories)

Limitations:

• AI-enhanced features are provided "as is" without warranty
• We are not responsible for AI-generated content, accuracy, or availability
• AI features may be slow or unavailable if the third-party service is experiencing issues
• You may stop using AI features at any time by removing your API key in Settings

6. Intellectual Property

6.1 Our Content

HEKA Calendar and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

• Copy, modify, or create derivative works of the Service
• Distribute, sell, or sublicense the Service
• Remove any copyright or proprietary notices

6.2 Your Content

You retain ownership of any content you create in HEKA Calendar, including calendar notes, journal entries, and birth chart data.

You grant us a limited license to store, display, and transmit your content solely for the purpose of operating and improving the Service.

6.3 Feedback

Any feedback, suggestions, or ideas you provide may be used by us without compensation or attribution.

7. Data and Privacy

Your use of HEKA Calendar is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

Key privacy principles:

• Local-First: Most data stays on your device by default
• Optional Sync: Cloud features require explicit opt-in
• No Data Sale: We do not sell your personal information
• Export: You can export your data at any time

8. Third-Party Services

8.1 Firebase

Our optional cloud sync uses Firebase (Google). Your use of cloud features is subject to Google's Terms of Service.

8.2 AI Services (Bring Your Own API Key)

If you choose to provide API keys for AI services (OpenAI, Groq, Anthropic, Ollama):

Our Role: We act only as an integration layer. We do not provide AI services ourselves.

Your Relationship: You create accounts directly with AI providers and are subject to their terms of service, privacy policies, and pricing.

Data Flow:

1. Your device sends a prompt to the AI provider's API using YOUR key
2. The AI provider processes the request and returns a response
3. Your device displays the response in the app

8.3 App Stores

Your download and use of HEKA Calendar through app stores (Apple App Store, Google Play Store) is subject to those platforms' terms and conditions.

9. Disclaimers

9.1 "As Is" Disclaimer

HEKA Calendar is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, including but not limited to:

• Accuracy: We do not guarantee the accuracy of astrological calculations or interpretations
• Availability: We do not guarantee uninterrupted access to the Service
• Results: We do not guarantee any specific outcomes from using the Service

9.2 Astrology-Specific Disclaimer

9.3 Beta Features

Some features may be labeled as "beta" or "experimental." These features are provided for testing purposes and may contain bugs or be discontinued at any time.

10. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim (or $100 USD if you used the free version)
• We are not responsible for:
  • Loss of data due to device failure or user error
  • Inaccuracies in astrological interpretations
  • Third-party service outages (Firebase, AI services)
  • Actions taken based on astrological guidance

11. Indemnification

You agree to defend, indemnify, and hold harmless HEKA Calendar and its operators from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Service

12. Termination

12.1 By You

You may stop using HEKA Calendar at any time. To delete your account and cloud data, use the in-app settings or contact us.

12.2 By Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

12.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• Cloud data may be deleted after a reasonable grace period
• Local data on your devices remains under your control
• Provisions that by their nature should survive termination shall survive

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the revised Terms.

Material changes will be notified through:

• In-app notification
• Email to registered users (if applicable)
• Update to the "Last Updated" date

Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of New South Wales, Australia.

15. Dispute Resolution

15.1 Informal Resolution

Before filing a claim, you agree to try to resolve disputes informally by contacting us at hekacalendar@gmail.com. We'll attempt to resolve the dispute within 30 days.

15.2 Arbitration

If informal resolution fails, any dispute shall be resolved through binding arbitration (not court proceedings) in accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA).

Class Action Waiver: You agree that any proceedings will be conducted only on an individual basis and not as a class action, consolidated action, or representative action.

15.3 Exceptions

Either party may bring suit in court to:

• Enforce intellectual property rights
• Seek emergency injunctive relief

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HEKA Calendar regarding the Service, superseding any prior agreements.

19.1 Apple App Store

If you downloaded HEKA Calendar from the Apple App Store:

• These Terms are between you and HEKA Calendar, not Apple
• Apple has no obligation to furnish any maintenance or support services
• Apple is not responsible for addressing any claims related to the app
• Apple is a third-party beneficiary of these Terms

19.2 Google Play Store

If you downloaded HEKA Calendar from the Google Play Store:

• These Terms are between you and HEKA Calendar, not Google
• Google is not responsible for the app or its content
